EU competition law only regulates activities where trade between member states is affected to an "appreciable" degree, but member states may have higher standards that comply with social objectives. The main problem associated with dewatering is that it is not just the release of seawater re-entering the water column. Heavy metals such as copper and cobalt that would be sourced from the material extracted on the seafloor are also mixed in with the water that is released into the water column. The first environmental concern associated with the release of heavy metals is that it has the potential to change ocean chemistry within that localized water column area.
